ICM DESK IS A TECHNOLOGY PLATFORM AND DOES NOT CONSTITUTE A LAW FIRM, LEGAL PRACTICE, OR LEGAL SERVICE PROVIDER IN THE UNITED STATES, BRAZIL, OR ANY OTHER JURISDICTION. ICM DESK DOES NOT PROVIDE LEGAL ADVICE, LEGAL OPINIONS, LEGAL GUIDANCE, LEGAL REPRESENTATION, OR LEGAL CONSULTATION OF ANY KIND. ATTORNEY–CLIENT PRIVILEGE AND OTHER PROTECTIONS AVAILABLE FROM LICENSED ATTORNEYS DO NOT APPLY TO THE USE OF THE PLATFORM.

ICM Desk is owned and operated by ACFC Global, a technology company. The Platform provides tools for immigration case management, document preparation, and workflow automation for use by immigration law firms, consultancies, human resources departments, relocation agencies, and global mobility companies (each, a "Company"). ICM Desk is not a party to the professional services relationship between a Company and its clients.

2. Nature of Services and Platform Role

The ICM Desk platform provides technology tools and infrastructure that enable Companies to manage immigration cases, prepare documents, track case status, and communicate with their clients. The Platform offers, among other features:

(a)     Case management and workflow automation tools;

(b)     Document preparation and formatting systems, including templates;

(c)     AI-Powered and AI-Assisted document generation and form completion capabilities;

(d)     Integration with the USCIS Case Status API for informational case tracking; and

(e)     Secure communication channels between Companies and their clients.

For End Clients: Your Company, not ICM Desk, is the entity providing you with immigration-related services. ICM Desk provides the technology infrastructure that your Company uses to deliver those services. Any questions regarding your immigration case, legal strategy, document content, or case outcomes should be directed to your Company and, where applicable, to a qualified legal professional.

3. AI-Powered and AI-Assisted Services

THE PLATFORM INCORPORATES ARTIFICIAL INTELLIGENCE CAPABILITIES TO ASSIST WITH DOCUMENT PREPARATION, CONTENT GENERATION, FORM COMPLETION, AND OTHER TASKS. AI-GENERATED CONTENT MAY CONTAIN ERRORS, INACCURACIES, INCONSISTENCIES, OR UNEXPECTED RESULTS. AI-GENERATED CONTENT IS PROVIDED ON AN "AS IS" BASIS AND MUST BE INDEPENDENTLY REVIEWED AND VERIFIED BY QUALIFIED PERSONNEL BEFORE USE OR SUBMISSION TO ANY GOVERNMENT AUTHORITY.

AI Services may utilize third-party artificial intelligence providers, whose selection may change over time. ICM Desk does not provide user data to AI providers for the purpose of training or improving their models. ICM Desk does not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content for any particular purpose.

4. No Guarantee of Visa or Immigration Outcomes

ICM DESK MAKES NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES REGARDING THE APPROVAL, ACCEPTANCE, PROCESSING TIME, OR SUCCESS OF ANY VISA APPLICATION, PETITION, OR OTHER IMMIGRATION SUBMISSION. VISA AND IMMIGRATION DECISIONS ARE MADE SOLELY BY THE RELEVANT GOVERNMENT AUTHORITIES BASED ON THEIR OWN EVALUATION CRITERIA. ICM DESK HAS NO CONTROL OVER AND CANNOT INFLUENCE SUCH DECISIONS.

ICM Desk shall not be held liable for any denial, rejection, delay, request for evidence, or other adverse outcome of any immigration matter, regardless of whether documents, information, or forms were prepared, processed, or tracked using the Platform.

5. User Responsibility and Information Accuracy

Users are solely responsible for the accuracy, completeness, and truthfulness of all information provided through the Platform. ICM Desk does not verify, validate, or fact-check information entered by users and assumes no responsibility for errors, omissions, or inaccuracies in user-provided data.

Company Users are responsible for reviewing all documents and information generated through the Platform, including AI-generated content, before submission to government authorities, delivery to clients, or reliance thereon. End Clients are responsible for verifying the accuracy of their personal information and documents in coordination with their Company.

6. Uscis Case Status API

The Platform may integrate with the USCIS Case Status API to provide automated case status tracking. This feature is provided for informational convenience only. Case status information is sourced from USCIS and is subject to USCIS availability, terms of service, and data accuracy. ICM Desk does not guarantee the accuracy, completeness, or timeliness of case status information and is not liable for any reliance on such information.

7. Data Protection and Privacy

ICM Desk collects, stores, and processes personal information as necessary to provide the Platform and related services. Data handling is governed by our Privacy Policy and complies with applicable data protection laws, including the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR), and Brazil's Lei Geral de Proteção de Dados (LGPD), as applicable.

For End Clients, your Company is the primary data controller for your personal information. ICM Desk processes your data on behalf of your Company and, for certain purposes, as an independent data controller. For details, please review our Privacy Policy at http://icmdesk.com/privacy-policy.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ICM DESK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE FEES, IF ANY, PAID BY YOU DIRECTLY TO ICM DESK DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00). ICM DESK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, REGARDLESS OF THE THEORY OF LIABILITY.

9. Governing Law

This Legal Disclaimer is governed by the laws of the State of Florida, United States of America, without regard to its conflict of law principles. Use of the Platform is also subject to our Terms of Use, which contain binding arbitration and class action waiver provisions. Please review the Terms of Use at [LINK] for full details.
